Welcome to Marketing Vines! These Terms and Conditions ("Terms") govern your use of our website, services, and any communications with Marketing Vines Inc. By accessing or using our services, you agree to be bound by these Terms.


1. Services

Marketing Vines offers branding, web design, SEO, digital marketing, hosting, and related services. Services are provided based on your selected package and scope of work, which will be outlined in a written proposal or agreement.


Marketing Vines offers multiple monthly marketing and website service plans with varying levels of support, revisions, SEO work, and ongoing maintenance. Services included are limited to the scope of the client’s selected plan.


Launch Marketing Plan – $265/month


The Launch Marketing Plan includes standard business updates and routine website maintenance. Included maintenance services are intended for reasonable minor updates necessary to keep the website accurate and operational. Examples of included updates may include:

  • Updating business phone numbers, addresses, hours, or contact information
  • Updating logos or branding assets
  • Adding or replacing a reasonable amount of photos or media
  • Minor text edits or corrections
  • Standard website maintenance, hosting, and plugin updates


The Launch Marketing Plan does not include unlimited revisions, unlimited redesign requests, extensive website restructuring, advanced development work, large-scale content rewrites, or ongoing custom design requests.


Website maintenance and included updates under the Launch Marketing Plan are limited to a maximum of two (2) standard billable labor hours per calendar month. Any work requested beyond the included scope or time allowance may be billed separately at Marketing Vines’ current hourly rate or may require upgrading to a higher-tier service plan.


Growth Marketing Plan – $375/month


The Growth Marketing Plan includes expanded support services, including unlimited reasonable website updates and revisions, ongoing maintenance, SEO content creation, and Local SEO management. This plan is intended for businesses requiring active monthly growth, ongoing optimization, and more substantial website support.


“Unlimited updates & revisions” applies to reasonable business-related website requests completed during normal business operations and does not include complete website rebuilds, custom software development, third-party platform migrations, emergency after-hours work, or excessive requests deemed outside the intended scope of the plan. Marketing Vines reserves the right to define reasonable usage and recommend project-based pricing for requests exceeding normal ongoing website management services.


Ai Written Content Submissions


Marketing Vines reserves the right to decline, edit, rewrite, or refuse client-provided content, including content generated primarily through artificial intelligence (AI) tools, when we determine such content may negatively impact website quality, user experience, branding consistency, SEO performance, or long-term search engine visibility.


While AI tools may assist in brainstorming or drafting content, Marketing Vines does not support the mass replacement or rewriting of entire websites solely using AI-generated content strategies. Based on current industry best practices and search engine quality standards, low-quality or overly automated AI content may provide reduced long-term SEO value and may be ignored, devalued, or perform poorly in search engine rankings. Marketing Vines reserves the right to recommend or create original, human-edited content strategies that we believe better support long-term client growth and performance.


2. Payment Terms

  • Monthly Plans: Services are billed monthly and automatically renew unless canceled in writing.
  • Custom Projects: Custom work or one-time projects will follow the payment terms in the project proposal.
  • Late Payments: Failure to pay on time may result in service suspension or additional fees.
  • Cancellation: Clients may cancel monthly services at any time with written notice. No partial-month refunds will be issued.


3. Client Responsibilities

You agree to:

  • Provide accurate and timely information needed for your project
  • Review and approve drafts within reasonable timeframes
  • Not use any services for unlawful or unethical purposes
  • Clients can use the Client Dashboard, which provides 24/7 access to website performance statistics, analytics, and form responses.

Clients are solely responsible for the content, images, and data they provide or request to be used in websites or marketing materials.



4. Intellectual Property

  • All original designs, content, and code created by Marketing Vines remain the property of Marketing Vines until full payment is received.
  • Logos, brand kits, and websites developed by Marketing Vines are fully transferable to the client via the Duda platform.
  • Marketing Vines retains the right to display completed projects in our portfolio unless otherwise agreed in writing.



5. Website Hosting and Uptime

We host websites on trusted servers with high uptime, but we cannot guarantee 100% uninterrupted service. We are not liable for damages resulting from server outages, security breaches, or data loss beyond our reasonable control.



6. SEO & Marketing Performance

While we use best practices in SEO and digital marketing, we do not guarantee specific rankings, traffic increases, or financial results. SEO takes time, and many external factors impact performance.



7. SMS and Email Communications

If you opt in to receive SMS or email updates:

  • You agree to receive service-related and promotional messages
  • You can opt out anytime by replying "STOP" to SMS messages or clicking "unsubscribe" in emails
  • SMS consent is not shared with third parties
  • By opting into SMS from a web form or other medium, you are agreeing to receive SMS messages from Marketing Vines. This includes SMS messages for customer care. Message frequency varies. Message and data rates may apply. See privacy policy at www.marketingvines.com/privacy
  • Message HELP for help. Reply STOP to any message to opt out.



8. Termination of Service

Marketing Vines reserves the right to suspend or terminate services, access to systems, or ongoing business relationships at any time if a client violates these Terms and Conditions, fails to make timely payments, engages in misuse of services, or conducts themselves in a manner deemed detrimental to the working relationship. Marketing Vines also reserves the right to discontinue services or cease working with any client at its sole discretion.


Upon payment of all outstanding balances and final invoices owed, the client will receive ownership and transfer of all approved deliverables and assets developed by Marketing Vines for the client, including but not limited to website files, brand assets, and Brand Kit materials. In cases where Marketing Vines registered or acquired a domain name on behalf of the client, the domain will also be transferred to the client upon full payment of any remaining balances due.



9. Limitation of Liability

Marketing Vines shall not be liable for any indirect, incidental, or consequential damages arising out of the use or inability to use our services. Our total liability under any circumstance shall not exceed the amount paid to us for services within the previous 90 days.



10. Disclaimer of Warranties

All services are provided “as is” and “as available” without any warranties of any kind, whether express or implied. Marketing Vines makes no guarantees regarding the availability, accuracy, or reliability of services, nor any warranties of merchantability, fitness for a particular purpose, or non-infringement. Clients acknowledge that results may vary and depend on factors outside our control.



11. Force Majeure

Marketing Vines shall not be held liable or in breach of these Terms for delays or failures in performance caused by events beyond our reasonable control, including but not limited to natural disasters, power outages, strikes, labor disputes, server failures, cyberattacks, acts of God, changes to third-party platforms (e.g., Google algorithm updates, Duda outages), or governmental actions.



12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Fulton County, Georgia. Each party shall bear its own legal fees and costs, unless otherwise determined by the arbitrator.



13. Entire Agreement

These Terms, along with any written proposal, contract, or agreement between Marketing Vines and the client, constitute the entire agreement between the parties. They supersede all prior or contemporaneous understandings, communications, and agreements, whether written or oral. No verbal promises or representations shall be binding.
